I expressly point out that my massages are not a curative treatment within the meaning of the relevant legal provisions. No diagnoses are made, symptoms are treated or any promises are made. My massages can not replace prescribed medications, therapies, or visits to a doctor if you have a medical condition. My massages are pure wellness treatments that are solely for general relaxation, well-being and health prevention. If you have or suspect musculoskeletal or internal organ disorders, skin or cardiovascular disease, recent surgery or pregnancy, it is best to first ask a doctor to determine if massage is appropriate under these circumstances even contraindicated.

If, despite expert use, preventable consequential damages occur due to the fact that a customer has concealed or trivialized grounds for exclusion, the masseur / masseuse and owner of NICHA's original Thai massages are exempted from all liability. The same applies to damage caused by the fact that a reason for exclusion was not known to the customer and this was not recognizable to the masseuse / masseuse or the business owner. If you have or suspect a health condition, seek medical advice before starting a spa treatment.

When using massages, health aspects must be taken into account. Certain illnesses or health disorders may limit or even rule out treatment. We reserve the right to refuse massages or other wellness treatments in certain cases.

I reserve the right to make changes to promotion offers and bonus programs without notice. Reduced massages, vouchers and special offers are excluded from the bonus programs. Participation in bonus programs does not give rise to a legal claim.

The period of limitation of the vouchers issued by NICHA's original Thai massages amounts to 3 years at the end of the calendar year after the date of issue according to § 195 BGB. On each voucher the date of issue is noted. In case of limitation, NICHA's original Thai massages may refuse performance. A cash payment is excluded in any case. Vouchers can be transferred. For a voucher redemption, an appointment is required and the voucher must be presented to the appointment. A coupon can be split across multiple applications.

Basically, every agreed date for NICHA's original Thai massages and customer is binding. A cancellation or postponement must be made by both parties at least 24 hours in advance. If an untimely deadline cancellation or a customer does not appear on the agreed date, NICHA's original Thai massages reserve the right, according to § 615 BGB, to pay up to 75% of the fees for the service to be provided on the agreed date to pay the service due.

Should a provision of these General Terms and Conditions be ineffective or void, this does not affect the validity of the remaining terms and conditions. Any ineffective provision will be replaced by a legally valid provision that comes as close as possible to the economic purpose of the invalid provision. NICHA's original Thai massage reserves the right to change the terms and conditions at any time without notice. Verbal collateral agreements are considered not met. Any amendment or supplement to the contractual agreements must be in writing for verification purposes. Jurisdiction for all disputes is Kaiserslautern.
